Users are required to read these Terms and Conditions before using the services of the website www.workout4.me

1. Terms and Conditions - these rules and regulations, specifying the rules for the provision of services on the Website.
2. Service - web portal located at www.workout4.me and enabling the purchase and use of services provided electronically by the Service Provider
3. Service Provider - company wirfes sp. z o.o. based in Kłobuck, 11 Listopada 3 street registered under KRS number 0000881585 at the District Court in Częstochowa, XVII Commercial Division of the National Court Register, NIP 5742072345, REGON 388073538
4. Customer - natural person (consumer), ordering a Service through the Website.
5. Standard Account - service provided free of charge by the Service Provider to the User via the Website.
6. Premium Account - the 'PREMIUM Account for a year' service provided for a fee by the Service Provider to the User via the Website.
7. Generator – a proprietary IT solution for generating Workout Plans.
8. Workout Plan - a recreational strength training plan consisting of individual physical exercises.

1. The Service operates on the terms and conditions set forth in these Regulations.
2. The Regulations define the type, scope and terms of the Service provided by the Service Provider through the Site.
3. Beginning to use the Service, is tantamount to acceptance of these Regulations and the resulting rights and conditions by the User.
4. In order to use the Service, it is necessary for the User to register on the Site.
5. Registration on the Service is voluntary and free of charge.
6. The user may contact the Service Provider using the e-mail address info@workout4.me
7. In order to delete a User's account from the Service, send a message requesting the deletion of the account from the email address provided when registering with the Service to the following address info@workout4.me
8. The User declares that he/she is an adult natural person (consumer) with full legal capacity and does not represent any company by using the Service.
9. The Service Provider declares that it will endeavor to provide the User with the Service free of defects.

1. A Premium Account on the Service is available to a registered User who has purchased and paid for access to the Premium Account. The User may use the Premium Account for a period of one year from the date of payment.
2. Premium Account includes access to the following services:
1. Workout log - allows you to save workouts, as well as view saved workouts
2. Generator - allows you to automatically create a training plan based on the entered data
3. Workout Plans - allows you to create and manage workout plans
4. Customer Support - allows you to send inquiries regarding the use of the Service
3. The Service Provider stipulates that it does not guarantee the indefinite availability of data on the service after the expiration of the Premium Service.
4. The Service Provider stipulates that due to its territorial coverage, it does not guarantee the performance of the Service for users outside the EU territory.
5. The Service Provider shall endeavor to ensure that the Service works correctly and is available. However, it does not guarantee the continuous availability of the Service, operation completely free of errors as well as the accuracy, completeness, correctness of all information contained in the Service.
6. The conditions for the performance of the Service by the Service Provider are:
1. met the Technical Requirements described in Section 10 of these Regulations,
2. fulfilled conditions described in Section 2h of these Terms and Conditions,
3. registration of an account on the Website by the User,
4. clicking the button "Confirm and Pay",
5. making full payment for the Service,

1. A Standard Account on the Service is available to a registered User who does not have access to a Premium Account.
2. The Standard Account includes limited access to the following parts of the Service
1. Workout log - allows limited recording of workouts, as well as limited viewing of recorded workouts
2. Workout Plans - allows limited management of workout plans
3. The Service Provider informs that the scope of the service may change including its removal from the offer.
4. The Service Provider reserves the right to remove the free Standard Account to the User without giving any reason, although it does not want and does not plan to do so.
5. The Service Provider informs that it does not guarantee indefinite availability of plans and workouts within the Standard Account.
6. The Service Provider informs that due to its territorial coverage, it does not guarantee the performance of the service for users outside the EU.
7. The service provider informs that the Standard account may contain advertisements.

1. The order for the Service by the User is placed when the User clicks the button "Confirm and pay".
2. The contract for the provision of the Service shall be deemed to be concluded when the User makes full payment.
3. The payment should be made by the User in advance and is a necessary condition for the use of the Premium Account.
4. The price of the Service is the gross price expressed in Euro and it is given to the User before the order.
5. The contract for the provision of the Service is terminated when the Service Provider performs the Service.
6. The following forms of payment are possible:
• By bank transfer or payment card through Stripe's online payment systems.
7. The terms and conditions of payment processing are defined in the service regulations of payment operators.
8. No information regarding access to bank accounts or credit card numbers is stored on the Service.
9. In order to obtain a bill or invoice for the service for individuals, please send an appropriate message to the email address info@workout4.me containing the name and address of the purchaser.
10. The user, in accordance with applicable law, may withdraw from the contract without giving any reason before the expiry of 14 days from the conclusion of the contract. In this case, please send a message with information about withdrawal to the email address info@workout4.me

1. The price of the service "Premium Account" is listed on the offer page and is visible to the User before the purchase.
2. The service allows the possibility of offering lower promotional prices, of which the User will be informed before the purchase.

1. Complaints should be submitted by sending an email with a description of the case address info@workout4.me
2. The time limit for filing a complaint is 365 days from the completion of the order described in Section 4 of the Terms and Conditions.
3. Complaints will be considered by the Service Provider no later than 14 days from the date of submission.
4. The User will be notified of the result of the complaint procedure in a message sent to the e-mail address from which the complaint was previously submitted.
5. Complaints are not subject to the manner of operation, structure, form, or graphic style of the application, if they do not prevent the use of the Service.
6. Complaints are not subject to any materials provided by the Service Provider to the User free of charge, including if they are provided as an addition to the paid Service provided.

1. The Service Provider declares that the Exercises, Workout Plans, Workout Tips and other materials are made available to the User in good faith and in accordance with the state of knowledge available to the Service Provider.
2. The use of the information contained in the Service and, in particular, the use of the Workout Plans available on the Service is solely at the responsibility of the User.
3. Before performing the exercises from the Workout Plan, the Service Provider recommends that you consult your doctor regarding the Workout Plan and perform any tests necessary to evaluate your health.
4. If you have any doubts about performing the exercises from the Workout Plan, the Service Provider recommends that you seek the advice of a qualified trainer.
5. The Service Provider specifically stipulates that it is not responsible for.
1. any damage caused during exercises performed on the basis of the Workout Plans generated on the Service
2. the effects of using the Workout Plans generated on the Website
6. The Service Provider makes no guarantee that the use of the Service will be without errors or technical interruptions.

1. The User is obliged to respect his/her personal rights and intellectual property rights when using the Service Provider's website.
2. All content on the Service website enjoys copyright protection and (except for elements used under Licenses or agreements transferring copyrights) is the property of the Service Provider.
3. The User may use the generated training plan and other materials provided to him/her as part of the implementation of the Service for his/her own purposes.
4. The remuneration for the Service does not transfer copyright or any other intellectual rights to the User.
5. Any commercial use or sharing of materials made available as a result of the Service in whole or in parts requires the written consent of the Service Provider.
6. It is forbidden to upload unlawful content to the Service.
7. The User, by submitting content to the Service, shall be solely responsible for possible violations of copyright and related rights and personal rights of third parties resulting from such content.

In order to properly use the Website and the Service, the following are required:

1. having an active e-mail address,
2. having a multimedia device with internet access,
3. updated Google Chrome web browser,
4. active (enabled) download of cookies in the browser,
5. active (enabled) Javascript support in the browser,

1. The Terms and Conditions are effective as of 01.01.2024
2. The Service Provider reserves the right to change the Terms and Conditions for important reasons. Changes to the Regulations will be announced through the Service.
3. Important reasons for changing the Regulations may be, for example:
• Change of company data (e.g. address, name).
• Changes in legal regulations.
• Technical changes related to the functioning of the Service
• Changes in the scope of the business (e.g. new products, services)
• Changes related to the establishment and termination of the contract
4. The Regulations shall be governed by Polish law. In matters not regulated by the Regulations, the provisions of the Act on the provision of services by electronic means, the Civil Code, the Act on the protection of personal data and other applicable laws shall apply.
5. If any provision of the Terms and Conditions is deemed illegal or invalid, the Service Provider shall endeavor to have such provision amended or excluded from the Terms and Conditions, which shall not affect the validity of the remaining provisions of the Terms and Conditions.
6. Any disputes arising between the Service Provider and the Users will be resolved in the first instance by negotiation, with the intention of concluding the dispute amicably.
7. If disputes cannot be resolved through negotiations, they will be settled by the court having jurisdiction over the Service Provider's headquarters or the User's place of residence.
